How does that all work, though?
For those unaware, the 2018 Farm Bill decriminalized hemp products, which includes any and all hemp CBD and indeed all CBD products. Also known as the Agriculture Improvement Act of 2018, the bill decriminalized any and all hemp products and all CBD products in the bargain, so long as it met certain criteria.
Mainly, such products cannot contain any more than 0.3 percent - by weight - of THC. Even the federal government knows that hemp products contain trace amounts of THC, but that was the ceiling set for any hemp or other CBD product to be allowed for sale in the United States.
That's as far as the US Justice Department is concerned. However, the Food and Drug Administration is a little bit more hard-nosed.
The FDA has rules about what can and can't be sold or marketed as food, as well as what can and can't be sold or marketed as medicine. Medicines...require a lengthy vetting process (clinical trials) that take many years to complete, and foodstuffs likewise have have to be thoroughly tested before the FDA gives their seal of approval.
In the case of CBD products, the FDA has not approved medicinal use beyond two forms of childhood epilepsy, for which CBD oil - in the form of a prescription CBD oil called Epidiolex - can be prescribed. Not just purchased; it has to be prescribed by a doctor.
Food likewise has to be established as being safe for consumption, and food products containing CBD haven't been proven to be. Granted, foodstuffs containing CBD haven't been proven to be unsafe; it's just that the testing hasn't been done yet.
As a result, CBD cannot be sold as nor marketed as medicine (save for Epidiolex) and food products containing CBD - as far as the federal government is concerned - are not approved for sale.
But what does that mean about CBD balm?
Since CBD balm is not a medicine or a medicated ointment - it is an ointment that can be used on your skin if you so choose - it therefore doesn't run afoul of FDA regulations concerning medicated balms and ointments. Since it also definitely isn't food, it therefore also doesn't fall under FDA regulations concerning food products.
As a result, there is no prohibition on CBD balm or other CBD products that likewise don't butt up against FDA regulation from being shipped or otherwise transported across state lines, which is relevant since the federal government has purview over interstate commerce.
